content, photographs, graphics, images, illustrations, marks, logos, sound or

partners, or licensors may be subject to additional restrictions. You agree not
to modify, reproduce, retransmit, distribute, disseminate, sell, publish, create
derivative works of, broadcast, circulate or in any way exploit any of the
materials or content received through the Site to anyone without Foodmove.com’s
express prior written consent.

Internet sites owned by third parties. Your use of each of those sites is
subject to the conditions, if any, that each of those sites has posted. We have
no control over sites that are not ours, and we are not responsible for any
changes to or content on them. Our inclusion on our sites of any third-party

third-party site.
Use of Site
By viewing and/or using this Site, you
agree that Foodmove.com will not be liable for any commercial loss;
inconvenience; loss of use, time, data, goodwill, revenues, profits, or savings;
or any other special, incidental, indirect, or consequential damages in any way
related to or arising from your use of this Site and/or Services. You agree to
defend, indemnify and hold harmless Foodmove.com, its employees, directors,
shareholders, members, officers, agents, subsidiaries and affiliates from any
and all claims, losses, damages, causes of action, liabilities and expenses
(including reasonable attorneys’ fees) related to or arising out of your use of
the Site and/or Services, including without limitation claims made by third
parties related to your use of the Site and/or Services.
Foodmove.com does not assume any
responsibility or liability for the actions, products, and content of any third
parties related to the creation or delivery of your order.
All orders purchased through
Foodmove.com are made pursuant to a delivery contract with individual
restaurants. If there are delivery errors, Foodmove.com will offer reasonable
assistance in the correction of that error. However, the risk of loss and title
for such items pass to you upon our delivery to the carrier. Foodmove.com reserves the right to refuse or revoke
service at its own discretion. You must be at least thirteen years of age to use
this website.
Payment
By using this site, you agree to pay
all fees and charges incurred with your purchases in addition to any applicable
taxes. At this time the only method of payment accepted is with a valid
credit/debit card. You must be authorized to use the card information you
provide to Foodmove.com. Because of the progressive discounts offered as groups
grow in size, the final charges for your order may be different than those
stated on the website at the time of your purchase. Your final order charge will
sent in your order confirmation receipt after your group has been closed for
delivery.
Cancellation/Refund Policy
Each group order that you belong to
will display a time at which the group will close, allowing the restaurant
adequate time to prepare and deliver the orders. You may only cancel or amend
your order before your group has closed. In some cases, it may be possible to
add a new order to a closed group before the orders go out for delivery. In such
cases, you will not be allowed to cancel your order once placed. Also, if a
group order closes without the total order amount reaching the displayed minimum
amount required for delivery, all individual orders in that group will be
automatically cancelled.
If
you are not satisfied with your order please contact Foodmove.com at
support@foodmove.com within 24 hours
with the restaurant name, your order number, and a description of the issue you
experienced. All sales are final unless we confirm the issue with our partnering
restaurants or determine, at our sole discretion, the issue to be actionable. In
such cases, Foodmove.com may issue credit or discounts for future use on food
orders through Foodmove.com. No cash refunds will be issued by Foodmove.com. All
inquiries regarding problems or issues with orders must be received within 24
hours of the order date listed on your order confirmation email.

We and our advertisers, partners, and
licensors provide the Foodmove.com site and services on an “as is” and “as
provided” basis, without any warranty or condition of any kind, express or
implied, and specifically disclaim any implied warranties of non-infringement,
title, merchantability, fitness for a particular purpose and availability of the
site or services. Foodmove.com makes no representation that the site and/or
services will be uninterrupted or error, bug or virus free and shall not be held
responsible in any way or by any means, either directly or indirectly, for any
communications difficulties, access delays, any interruption and/or data

Applicable Law

shall be construed in accordance with the laws of the State of Utah. As such, the laws of the State of Utah will govern these
